How An Old Friend
Became My ClientIn Denver, in the mid 70's, back before video games and cell phones, me and my buddies used to hang out at John's house. John's parents had the biggest and best house in our neighborhood. They had all of the toys, too. A basketball hoop in the big "half-court" driveway, ping pong & pool tables, a go-cart, a mini-bike, a football field sized yard. You name it, they had it!
But we didn't just hang out at John's house because of all the toys. It just so happened that Mr. & Mrs. Z were the coolest parents in the neighborhood. They were always getting involved in games. Mr. Z would take us fishing sometimes. Mrs. Z always had the best peanut butter cookies in the oven. I think they just enjoyed having us guys around.
When I was in high school, my family moved away from that neighborhood. I stayed in touch with John for awhile but we finally drifted apart and lost touch.
A few years ago I got a phone call from John with a question I never expected.
The phone rang, I picked up, and heard John’s voice on the other end of the line. For a few minutes, we talked about the old days and our careers…
… You know, “How’s the weather,” “How’s the kids,” “How’s your dental practice in Boston.” Normal, stuff.
Then he dropped the bomb.
“You know, Russell, my dad passed away a little over a year ago from a heart attack, and mom just passed away last week after a long term illness." "We just got back from the funeral yesterday."
As you can imagine, I was stunned. An early picture of Mr. & Mrs. Z flashed in my head and I felt a little sick. "I'm so sorry to hear that", I said. "I really liked your parents."
It turned out that in the will, John had been named as Executor of the estate. John told me about how his parents had never moved from their house here in Denver and how the house was now in a state of disrepair.
To make matters worse, John had a busy Dental practice in Boston, over 2,000 miles away. Needless to say, the distance created another problem.
John, knowing I was a certified real estate appraiser and broker here in Denver, had tracked me down to see if I would appraise the house and get it on the market. No problem!
I went over to take a look at the house. I pulled up in front of the house where we had so many good times. I felt a sense of nostalgia but also sadness when I noticed the overgrown yard, the broken garage door and the peeling paint on the siding. The basketball hoop was rusted and hanging down.
Then, I could barely squeeze in the front door because...
Mrs. Z never threw anything away.
Mrs. Z. wasn't a "hoarder" but she kept everything, plus she had some nice figurine collections, vintage jewelry and some vintage clothing from the 1950's, which were mostly furs and gowns. Mr. Z had a vintage baseball sports memorabilia collection, cool stuff from the 1920's. Signed baseballs, gloves, photographs, things like that. Mr. Z. also had kept an old, valuable law library.
It seemed that on every available flat surface, there were knick knacks.
I called John up after looking at the house and all of the stuff, which was nearly busting out of the doors and windows. John and his wife Laura had barely had a chance to look at the house when they were here in Denver for the funeral.
I said "John, what are you going to do with all of that stuff?!" We need to have the house cleared out and cleaned before I can get it on the market.
John broke down, right then and there over the phone. "I don't know where to start, Russell". "I'm so confused." "Between having to keep my practice running and dealing with all of this, I don't know if I can handle it all." "I don't know why Mom wouldn't just get rid of all that stuff and move into a condo, like we talked about when she was still here." I felt bad for John. He was going through all the depressing emotions. Sadness, anger, guilt, anxiety, fear, everything but joy.
John said, "I need your help, Russell." I said, "No problem, I'm here and I'll help you take care of everything". I really wanted to help, so...
I Needed a Solution, And I Took
A Couple Days To Think About It…I said to myself, "Let's see. I know the real estate stuff, so no problem there. What will I do about all the personal stuff, the collections, the house repairs, the lawn maintenance?"
So, the first thing I realized was that I needed to make a to-do list, then I needed to get some help.
I finally came up with the following actual list of things that needed to get done:
- Have a locksmith change all of the door locks.
- Secure all doors & windows in the house.
- Move all valuable personal property to a safe storage unit.
- Turn the water off inside the house and have the plumbing system winterized.
- Have John & his family decide which items from the house they want to keep & ship the stuff to them.
- Start initial lawn service: bushes trimmed, lawn mowed & manicured.
- Find a reputable estate sale company to appraise the personal property and schedule an estate sale.
- Appraise the house as-is, including minor repairs to make it presentable & send the report to John.
- Bring valuables back to the house in time for the estate sale.
- Items that don't sell at the estate sale are donated to John's favorite charity.
- Send John the cashier's check for the estate's percentage of the estate sale proceeds.
- Have the house cleaned out and have minor repairs made.
- Implement my 10 step, 200 point marketing plan to sell the house.
- When the buyer is ready to close, have title company forward all paperwork to John for signatures.
- After the buyer closes on the house, title company will wire funds to the estate's account.
That's almost exactly how it went. At first, I wasn't sure I could handle everything else, on top of having to sell the house. But, I was in a much better emotional state than John and with good help he was able to honor his parents and we were able to get it all done. While we were taking care of everything here, John was able to keep his Dental practice running in Boston. He never once had to come back to Denver during the whole process.

Step 1: Free Initial Consultation: Know Your Options
If you want to handle settlement of the estate in the best possible way, so you can put this all behind you and get on with your life, you need to know and understand your options for protection, preservation and liquidation of the estate's assets. Knowing market value of the personal property and real estate will also help you make good decisions. So Step 1 Initial Consultation, gives you a basic understanding the value of the estate's property and what your options are.
Here's how we like to work:

- We will complete an appraisal inspection and security risk analysis of all estate property, including real estate.
- Our personal property professionals will make an assessment of value for personal property.
- For high value art, collectibles, jewelry or antiques, we will recommend a local, knowledgeable appraiser.
- For real estate, we will prepare a free Broker Price Opinion report with a full appraisal style analysis of market value.
- If you require it, we can provide you with a referral for reputable, local commercial real estate and/or business brokers.

After all paperwork is approved by you as Personal Representative, then we move to step 2.
Step 2: Property Protection & Preservation
During our initial inspection of the estate's personal property and real estate, we will have completed a property risk analysis report. The risk assessment report includes analysis of potential risk to property as a result of theft, water, fire or other causes. So Step 2 Property Protection and Preservation, includes our recommendations to you for protection of personal property as well as initial set up of our Property Preservation Services.
All of the property services in step 2 (below) are included at no additional charge when you hire us to sell the estate's real estate:
- We remove small valuable items and send them to you or move them to a secure location of your choice. Storage unit, etc
- We photograph and videotape all property contents and exterior and interior condition of all real estate.
- With your approval, we will have our locksmith professionally re-key all door locks to real estate and mail you a new key.
- We will make sure all property windows and doors are secured and provide "board-up" service if necessary.
- With your approval, we will have the water turned off and the plumbing system winterized to prevent pipe freezing.
- We will begin weekly lawn mowing service or snow removal service.
- We will inspect the interior and exterior of the property weekly and provide you with a weekly report.
- We will notify you immediately if damage to the property is discovered.
- If a break-in is discovered, we will notify the local authorities and you immediately.
- We know many local, reputable contractors, who can provide you with estimates for necessary property repairs.
These services alone will help give you peace of mind. No other real estate company or broker could include these property protection and preservation services without charging you extra. Since all we do is work with estates, we understand your needs and have set up a system to handle them.
On to step 3...
Step 3: Liquidate Personal Property: Estate Sale, Donated or Disposed Of
By now, you've decided which personal items you want to keep. It's time to deal with the rest of the stuff. So Step 3 Liquidate Personal Property, is the time to deal with all of the personal property you don't want to keep.
Here's how it should go:
- Remove all personal items and vehicles that you want to keep from the property. We can ship them to you at your expense.
- If you want to hold the estate sale yourself, we can provide you with directional signs and interior notices.
- For items you want to have auctioned or consigned, we can have them delivered to those businesses for you.
- In some cases, we can make an offer to buy out the estate.
- If you have agreed that we will handle the estate sale, we begin the process of setting up the sale.
- There are no "out of pocket" expenses to you.
- It can take up to 2 weeks to prepare for the estate sale, including pricing, staging, advertising, etc.
- The estate sale is held over 2-4 days, depending upon the amount of personal property.
- Upon completion of the estate sale, we send you a cashier's check for your portion (65% on average) of the sale proceeds.
- We will provide you with an inventory of items that did not sell.
- You will decide if the unsold items should be kept, donated, recycled or disposed of.
- The property is cleared of all remaining personal items, trash removed and "broom" cleaned.
Then on to the real estate in step 4...
Step 4: Sell the Estate's Real Estate
Now that all personal property has been sold or removed, we're ready for Step 4 Sell the Estate's Real Estate.
If you don't live in Colorado, in most cases there should never be a need for you to be here to deal with the real estate. We can handle everything for you, from getting bids for cleaning or repairs and meeting contractors if necessary. You won't even have to be here for close of escrow. We can have all paperwork sent to you for signatures. You'll save on expensive airline tickets and rental cars.
Here's how it should go:
- Considering our recommendations, you decide on an asking price and if the property will be sold as-is or as-repaired .
- If the property will be sold as-repaired, we meet contractors to get repair bids and for property access to make repairs.
- If necessary, we will line up a professional cleaning crew and stager for you..
- Property preparation for market is completed.
- Marketing materials are completed: Ad Copy, MLS, Signs, Photos, Brochures, Internet, more.
- Our Powerful Property Marketing System is Launched: Marketing blitz coordinated with open house to attract buyers.
- We email weekly market updates to you and make recommendations due to changing market conditions & buyer feedback.
- Negotiate Buyer Offers: Advise you on pros vs. cons of each offer. Our job is to get you the best price and terms.
- Coordinate to Closing: Showings, Inspections, Appraisals, Title, Handle All Paperwork, more.
- Manage Close of Escrow: Make sure transaction is closed and you receive proceeds from the sale.
- Meanwhile, we are maintaining the lawn and watching the property for you.

Where Did the Money Go?
Two Short Cautionary TalesThe Family Home Sold And A “Shocking” Surprise
A couple of years ago, I visited a client who told me about her uncle. After he died, his heirs needed to sell his charming 1890's Victorian home in Denver, the house they grew up in and had been in the family for over 70 years.
They needed to sell it quickly, to come up with enough money to pay some creditors of the estate.
Well, before the heirs could talk to a Realtor or an appraiser, they received a call from a local real estate investor who wanted to see the house. During the appointment, the investor pointed out all of the problems with the house. He assured them that $170,000 was the most they could expect to get, considering that the home needed to be repaired and updated. And he reminded them that if they sold the house to him, they wouldn't have to pay a broker's commission.
So, they accepted his cash offer of $170,000, with a fast closing in two weeks.
It was the day of closing. Everyone showed up at the title company, including the Executor of the estate and the Investor. All papers were signed and the house was transferred to the investor.
After leaving the office, the Executor realized he had forgotten his phone in the closing room. When he went back inside to get his phone, he noticed that the investor was there having what appeared to be another closing.
He confronted the investor, who told him that he had already found another buyer for the property and that they were indeed having a closing. At that point, there was nothing he could do, so he left.
Two weeks went by and the Executor decided to check with the Denver Clerk & Recorder to make sure the deed had been recorded. When he called the recorders office, they told him that in fact, two deeds had been recorded on the same day. One sale for $170,000 and another sale for $247,000.
Turns out, the investor had made $77,000 profit in one day, without lifting one finger to make one repair to the house.
This type of investor is known as a "wholesaler". Unlike a fix & flip investor, they try to negotiate the lowest price possible, then immediately sell the property to another party, without adding any value whatsoever. Some are vultures, who swoop in to prey on uninformed, desperate people in desperate situations. Many of them have convinced themselves that they are actually helping the people they prey upon. Beware, these people have no conscience and will take you for every penny.
Lesson: Always get an Appraisal or Broker Price Opinion before accepting any offer on a property.
The "Favorite" Granddaughter
This story comes from my friend's stepsister.
It seems Mary, the birth mother of my friend's stepsister died a few years ago after a long battle with Alzheimer's disease.
Rebecca, Mary's first granddaughter, was the only other relative living near her in Denver, Colorado. The family, who were all spread apart in different cities, appreciated that Rebecca would occasionally check on Mary while she had full time care in her home.
After Mary passed away, Cynthia (the Executor) and the other three heirs who lived out of state, decided that it would be easiest if Rebecca took care of the house and other estate property, just until they could have an estate sale and then sell the house.
Everything was going well. After a couple of weeks, probate was opened and granddaughter Rebecca had agreed to handle the estate sale.
Then all of the sudden, no one could reach Rebecca.
To everyone's surprise, it was as if Rebecca had disappeared off the face of the earth. Rebecca wouldn't answer her phone or return messages. Finally, Cynthia realized that she had to ask her boss for some time off, so she could catch a flight from Chicago to Denver. She had to try and find Rebecca and also deal with the estate property.
Cynthia rented a car. As she pulled up to the house, she almost didn't recognize it. Weeds in the front yard were almost 3 feet high. There were flyers all over the front door. As she walked up onto the porch, she saw a notice posted on the front door from the City and County of Denver. The notice stated that if the weeds were not cut, the city would have them cut and there would be a fine.
As she let herself into the house through the unlocked front door, she noticed that the antique 1770's English grandfather clock, which had been a prominent piece in the entry for years, was gone.
As Cynthia took an inventory of the house contents, she realized that there were several other missing heirlooms and jewelry.
Cynthia felt betrayed by Rebecca.
As it turned out, Rebecca had a bad Vicodin drug abuse problem. She would disappear with her boyfriend, (a career criminal), for days a time. According to the neighbors, Rebecca and her boyfriend had even held an all night party in the house!
I recommend that all property be secured, immediately after death. That means moving all valuable property to a secured location, like a locked storage facility or safe deposit box. For homes, locks should be changed immediately and all windows and doors secured. You never know who might have a copy of the key.

… Well, consider this story from one of my clients.
The Reason Real Estate Agents
Have a Bad ReputationAwhile back I set up an appointment at an estate house with a Personal Representative and soon-to-be client. It seems my client’s brother (the now former Personal Representative) had signed a 6 month listing agreement with another broker. The broker had convinced him that he understood how to market and sell probate real estate.
Six months had passed and not even one offer had been received on the house.
When I called the buyer's agents who had previously shown the home, I found out that some of the buyers had considered making an offer, but didn't because they were concerned about a structural problem with the foundation.
What?! A structural problem? No way, I thought.
It turned out that the house needed a very minor stucco siding repair, which actually looked like a foundation problem and it was scaring away the buyers. The other agent never asked for feedback from the buyer's agents and so the house just sat on the market.
Not only that, the house didn't show well because it was dirty and still had leftover stuff lying around everywhere.
My client could not believe what had happened (or not happened)! So how did this all go so terribly wrong?
Lack of communication between the agent an the client, who were nearly 1,500 miles apart.
We hired a crew to take the leftover stuff to a local charity and clean the house out really well. A contractor was hired to make the stucco siding repair for $200.
We got the property back on the market and believe it or not, the house sold within 2 weeks and — at above asking price! Go figure.
Not all real estate brokers are that bad.
The question is:
How do you know if a real estate broker is qualified and prepared to help you
with the special aspects of selling probate real estate property?
Ask your real estate broker:

1: Are They Set up to Manage Vacant Estate Properties? Most brokers deal with sellers who live in and maintain their homes while on the market. Estate properties are usually vacant and need regular lawn maintenance and snow removal. They require regular inspections for break-ins, looting and weather damage. Initially, estate properties may need a locksmith, window board-ups, repairs and plumbing system winterization.
When we list an estate property for sale, our weekly maintenance and inspection process kicks in, so even if you live thousands of miles away, you won't have to worry. Our system also includes initial locksmith service, plumbing system winterization (during cold months) and assessment of potential security risks.

2: Do They Understand the Special Legal Considerations of Selling Estate Properties? Unlike a normal real estate transaction, estate properties require dealing with estate attorneys, probate courts, personal representative & trust deeds, special property disclosure issues and more. Even the seasoned local neighborhood real estate broker, should not be learning how to deal with estate properties at your expense.
Because we are used to dealing with all of the nuances of estate property sales, your real estate transaction should go much smoother than it would with an inexperienced broker.

3: Do They Have Experience Appraising Probate Real Estate? In many cases, estate properties have not been updated for several years and are sometimes in need of repairs. Because of necessary repairs, a property may not qualify for certain types of popular government financing programs, including FHA and VA. In some cases a property may be in such a state of disrepair, that it will not qualify for financing at all. When you know the value of your estate property in as-is and as-repaired condition, you can decide if it's worth it to make repairs or just sell the property as-is.

4: Do They Know How to Deal with Families, Beneficiaries & Heirs Under Difficult Circumstances?
As the Executor, at a time when you're working through a major loss in your life, you don't need the added grief of someone going against your wishes, breaking confidentiality and creating more family trouble. -
Very often we get a call or a visit from a family member who is not the Personal Representative, wanting information about estate property. Throughout our relationship, it's important to us that we know and respect your wishes. Who do you wish us to speak to about property issues? Who has your permission to access property, and when? And so on.
Why take that chance with someone who is not set up to handle your needs and end up with the wrong people managing the liquidation of your estate, when all you need is right here, all in one place?
