As Personal Representative of the estate, it is your responsibility to determine the value of all property, including real estate.
Your attorney may recommend that you get an appraisal, completed by a Colorado Certified appraiser, to give you an opinion of the Fair Market Value of the estate's real property. In cases where an appraisal is cost prohibitive or unnecessary, a Broker Price Opinion will give you an estimated selling price.
A professional real estate appraisal is an important part of settling an estate. In Colorado, settlement of an estate typically requires an appraisal, completed by a qualified professional, to establish Fair Market Value for the residential property involved. Fair Market Value is defined as the price at which a property would change hands between a willing buyer and willing seller, neither being under compulsion to buy or sell.
For estate tax purposes or disposition of the estate's real property assets of the decedent, a "date of death" valuation is often required. Occaisionally, the Personal Representative of the estate may choose to have the date be six months after the date of death. We are accustomed to the procedures and requirements necessary to complete a retroactive appraisal, with a Fair Market Value opinion effective as of the date of death or six months later. Your tax and legal counsel should advise you as to which appraisal effective date is best.
